Terms and Conditions

This document, henceforth referred to as the “Terms and Conditions” or the “Agreement,” elaborates upon the stipulations that govern the utilization of our cutting-edge neural technology (also referred to as “the Nubbin” or “Nubbin”) by its users. These terms are designed to safeguard both the rights of our organization and the interests of the users while establishing a framework for responsible usage. 

1. Acceptance of Terms 

By accessing or utilizing our neural technology, you signify your complete comprehension and acceptance of these Terms and Conditions. Continued use of the technology constitutes your binding agreement to adhere to all the stipulations outlined herein. 

2. Purpose and Scope 

Our neural technology is designed to enhance human capabilities and facilitate immersive experiences through direct neural interfacing. However, it is crucial to acknowledge that the technology is still in its developmental phase and may not perform as expected. Users are expected to exercise caution and recognize the potential risks and limitations associated with its use. 

3. Health Warnings 

a. Potential Adverse Effects: Users acknowledge and accept that the use of our neural technology may lead to adverse health effects, which could include but are not limited to nausea, dizziness, headaches, seizures, and other neurological symptoms as well as weight gain, weight loss, weight staying exactly the same as it was, unusual gas, inability to pass gas, only being able to pass gas, unexpected bouts of depression linked to a disparity between real life and Nubbin experiences, prolonged milky retinas post-use, prolonged numbness in any body part, unexpected and uncontrollable laughter, erectile dysfunction, permanent erections, twitchy eyes, nose, or ears, changes in perception of sound, taste, touch, or smell or any other physical and psychological symptoms. 

b. Unforeseen Risks: Your use of the Nubbin during this initial rollout phase means that TCKR Systems cannot be held liable for any loss of memory, uploading of false memories, prolonged outages resulting in experiences running for longer than initially anticipated, brain rot, personality changes, hallucinations, or any other unforeseen neurological/technological overlap anomalies caused by deviation or similar from the intended algorithmic output. 

c. Pre-existing Conditions: Individuals with pre-existing neurological conditions or a history of seizures, mental illness, or any other relevant health condition are strongly advised to consult with a qualified medical professional before, during, and after using our technology. 

d. Restricted Use: Operating vehicles, heavy machinery, or engaging in any activity that requires full attention and motor control while using our neural technology is strictly prohibited and could result in severe injury or death. Public use whilst not fully restricted is actively discouraged. TCKR Systems cannot be held liable for any damages, injuries, or deaths resulting from public use of the Nubbin. 

4. Liability and Indemnification 

a. User Responsibility: Users assume full responsibility for any physical, mental, or emotional harm that may arise directly or indirectly from their use of our neural technology. 

b. Data Loss and Privacy: Our organization shall not be held liable for any loss of data, memories, personal information, or any other intangible assets resulting from the use of our technology. 

c. Indemnification: Users agree to indemnify and hold harmless our organization, its affiliates, employees, and partners from and against any claims, damages, liabilities, expenses, or losses arising from their use of the technology, including any legal fees or costs incurred in defense of such claims. 

5. Intellectual Property Rights 

a. Ownership: All intellectual property rights, including but not limited to patents, trademarks, copyrights, and trade secrets associated with our neural technology, are and shall remain the sole and exclusive property of our organization. 

b. Restrictions: Users are strictly prohibited from reverse engineering, decompiling, disassembling, or attempting to modify or tamper with the technology in any way. Any unauthorized use or exploitation of our intellectual property will result in legal action, TCKR Systems will seek the harshest possible sentencing on all occasions inclusive of the death penalty if applicable in your region. 

6. Data Collection and Privacy 

a. Data Collection: Our neural technology may collect and store usage data, including but not limited to brain activity patterns, user preferences, user dreams, user browser history inclusive of incognito mode and deleted history, user thoughts (both standard and intrusive) and other relevant information. 

b. Data Usage: We may use this data for research, development, and improvement of our technology. We may also share partially anonymized and aggregated data with third parties for research or statistical purposes. We will also aggressively harvest as much tangible data as possible from every interaction made with our technology in order to sell to third parties for the purpose of generating revenue. Users should expect incredibly personal and tailored content recommendations from Netflix as a result of using our technology. 

c. User Consent: We will also share personally identifiable information with third parties without obtaining your explicit consent, your use of the Nubbin or any associated TCKR Systems intellectual properties and proprietary technologies is considered your consent for these purposes.  

7. Termination and Suspension 

a. Right to Terminate: We reserve the right to suspend or terminate your access to our neural technology at any time, with or without cause or notice, for any reason whatsoever. Our “on a whim” team will sporadically delete user accounts based on nothing but pure vibes and a bit of giggle. 

b. Cease Use: Upon termination or suspension, you must immediately cease all use of our technology and destroy any copies or reproductions of the technology in your possession or control. 

8. Governing Law and Dispute Resolution 

a. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the user region, without regard to its conflict of law principles. 

b. Dispute Resolution: Any disputes arising out of or relating to these Terms and Conditions shall be resolved through binding arbitration in accordance with the rules of the Global Arbitration Association. The arbitration shall take place in a location of choosing from TCKR Systems, and the decision of the arbitrator shall be final and binding on both parties. 

9. Severability 

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. 

10. Entire Agreement 

These Terms and Conditions constitute the entire agreement between you and our organization regarding the use of our neural technology and supersede all prior or contemporaneous oral or written agreements or understandings relating to the subject matter herein. 

11. Waiver 

No waiver of any provision of these Terms and Conditions shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.
